2022.09.27 15:31 FThumb Why no client list? It's a[nother] mystery!
https://elliottfreed.substack.com/p/a-tale-of-two-judges Dot one:
In July, 2020, District Court Judge Esther Salas was assigned to the case against Deutsche Bank that involved money laundering by Ghislaine Maxwell's friend and suspected partner in the business of selling children to be raped, Jeffrey Epstein. There were other rich and powerful people implicated in the case. Four days after she was assigned the case, a gunman came to her home dressed as a delivery driver, shot and killed her son and shot and injured her husband. The shooting was quickly blamed on a man whose dead body was found shortly after. His death was ruled a suicide and the case was closed.
Dot two:
A year and a half later, DURING the trial of Ghislaine Maxwell for selling children into sexual slavery, the judge on the case, Alison Nathan, was offered a promotion by President Biden, on the official recommendation of Senator Chuck Schumer. After the offer was made, while the trial was ongoing, Nathan declared that Maxwell's client list would not be made public or used in any further investigations.
After the trial, in March, 2022, Nathan was confirmed by the senate as a circuit court judge.
And our media have been unable to connect the dots, because we don't do journalism any longer.

2021.11.28 22:09 ALiddleBiddle The judge, the lawyers and Ghislaine Maxwell: a scorecard for watching the trial in New York
By Julie K. Brown + Ben Weider November 28, 2021
Link to article The Judge Alison Nathan
United States District Judge Alison Nathan was appointed to the federal bench by former president Barack Obama in 2011. Prior to serving as a federal judge, she clerked for the late Supreme Court Justice John Paul Stevens, worked as counsel for the attorney general of New York and was an associate White House counsel and special assistant for Obama.
Nathan has presided over a number of high-profile copyright cases, including one in 2013 in which she ruled that two news organizations violated the copyright of a photographer by using for commercial purposes photos that had been posted on Twitter.
In February, Nathan took the rare step of asking the Department of Justice to open an investigation into possible misconduct by New York federal prosecutors who withheld evidence in a case involving an Iranian businessman charged with breaking U.S. sanctions by funneling millions of dollars to his family business in Iran. She also issued a blistering criticism of the office that handled the case.
Since being assigned to the Maxwell case, Nathan has made clear that she intends to keep the trial on track. She has issued a number of pre-trial rulings, including permitting prosecutors to use the word “victim” when discussing Maxwell’s accusers and allowing those accusers to testify anonymously using pseudonyms. She has also denied Maxwell bail on four occasions.
Nathan has carefully scrutinized document redactions proposed by both Maxwell and the prosecutors. She granted Maxwell’s request to keep secret undisclosed “sensational” information contained in the court documents and transcripts, noting that removal of the material was necessary to protect the integrity of the investigation and the privacy of third parties who are not part of the criminal case. However, she has limited some of the redactions proposed by prosecutors.
In another twist, Nathan last week was nominated to the U.S. Court of Appeals for the Second Circuit, one step away from the Supreme Court.
She said she intends to see the Maxwell case through to the end.
For the Prosecution
Alison G. Moe
Assistant U.S. Attorney Alison G. Moe is a member of the Southern District of New York’s Public Corruption Unit. Prior to the Maxwell case, she was one of the federal prosecutors pursuing fraud charges against Steve Bannon, Donald Trump’s top campaign adviser in 2016. Trump pardoned Bannon in January as the former adviser was awaiting trial on charges he duped individuals donating to build a privately sponsored section of the southern border wall.
Moe also took on a federal criminal case involving scam political action committees, and as a former member of Southern District of New York’s narcotics unit she prosecuted a number of drug-trafficking cases.
Moe is a graduate of Dartmouth College and Columbia Law School. Before joining the U.S. Attorney’s Office, she worked as an assistant corporate counsel in the New York City Law Department.
Maurene R. Comey
Assistant U.S. Attorney Maurene R. Comey has been with SDNY since 2014. She is a chief of the Violent and Organized Crime Unit. Comey is one of the assistant U.S. attorneys who charged a prominent New York gynecologist last year with sexually assaulting six women, including the wife of former Democratic presidential candidate Andrew Yang.
Comey was also involved in a 2019 sex trafficking case in which 11 men were indicted on allegations that they forced 10 victims, some of whom were minors, to be sexually assaulted and abused as part of a commercial sex operation.
A graduate of William & Mary and Harvard Law School, she is the daughter of former FBI Director James Comey, who once served as the U.S. attorney for the Southern District of New York.
Andrew Rohrbach
Assistant U.S. Attorney Andrew Rohrbach has been with SDNY since 2019. He previously served as an attorney for the Department of Justice. In 2013, while at Harvard Law School, Rohrbach was designated as the “best oralist” in the Ames Moot Court Competition. Among the judges of the competition were the late Supreme Court Justice Ruth Bader Ginsberg and Judge Merrick Garland, now the attorney general. He is also a graduate of Yale, where he served on the debate team.
Lara E. Pomerantz
Assistant U.S. Attorney Lara E. Pomerantz was hired by SDNY in 2015. Prior to becoming a federal prosecutor, Pomerantz was an associate with the New York law firm Simpson, Thacher & Bartlett.
She is a member of SDNY’s Public Corruption Unit. Most recently, she handled the prosecution of a Drug Enforcement Administration agent alleged to have helped a drug-trafficking gang smuggle cocaine from Puerto Rico to the mainland as part of a decades-long drug operation. The gang committed at least seven murders.
In 2018, Pomerantz successfully prosecuted the corruption case of Norman Seabrook, the flamboyant former boss of the association representing New York City corrections officers.
She is a graduate of Duke University and the University of Pennsylvania Law School.
For the Defense
Bobbie Sternheim
Ghislaine Maxwell’s trial is undoubtedly defense attorney Bobbi Sternheim’s most prominent case, but she is no stranger to defending the accused accomplices of notorious men. She represented a Saudi man accused of being one of Osama bin Laden’s top deputies, as well as a Vietnamese man accused of a thwarted suicide bombing plot at London’s Heathrow airport at the direction of another Al Qaeda leader, the American Anwar al-Awlaki.
Both men were ultimately convicted and the 2016 trial of the Vietnamese man, Minh Quang Pham, was overseen by Nathan, who was recently recommended by Senate Majority Leader Chuck Schumer for an appointment to the U.S. Court of Appeals for the Second Circuit.
Sternheim has a long history in New York as a defense attorney and has defended alleged members of organized crime, drug dealers and public officials accused of corruption.
Sternheim has repeatedly raised concerns about Maxwell’s treatment in federal custody at Brooklyn’s Metropolitan Detention Center. She previously brought a medical malpractice suit against the facility on behalf of Sean Erez, a convicted drug kingpin who had attracted notoriety for using young Hasidic Jewish men as his drug mules. The case was settled.
Sternheim, a graduate of the State University of New York at Buffalo, John Jay College of Criminal Justice and the Benjamin N. Cardozo School of Law at Yeshiva Univesity, has served as the president of the New York Women’s Bar Association from 1992 to 1993 and is currently the Criminal Justice Act representative for the Southern District of New York, representing private attorneys appointed by federal courts to provide legal services to defendants who can’t afford to pay. She has taught law courses at Pace University and Yeshiva University’s Cardozo School of Law, her alma mater, where she has led the Intensive Trial Advocacy Program.
The Maxwell trial might introduce her to many, but she’s had at least one moment in the spotlight before: In 1993, she was cast to stand in for soap opera star Linda Dano on “Another World.” Asked about the experience on CNN, Sternheim said her years as an attorney came in handy.
“When one is in court as a litigator, one can be theatrical in front of a jury,” she said. “And I suppose there are some similarities.”
Laura Menninger
Laura Menninger has been an attorney in Colorado for the past 20 years, though earlier in her career she clerked for a judge in the Southern District of New York, U.S. District Judge Lewis A. Kaplan, who officiated at her 1999 wedding.
Kaplan is currently presiding over the lawsuit brought against Prince Andrew by Virginia Giuffre, who has said Maxwell recruited her for Jeffrey Epstein’s abuse and that Maxwell and Epstein trafficked her to various high-profile friends. Menninger also represented Maxwell in a defamation lawsuit Giuffre brought against her in 2015, which was settled in 2017.
Menninger, who was a public defender in Colorado before joining the firm of Haddon, Morgan and Foreman, has represented an acupuncturist accused of sexually assaulting clients, a cannabis dispensary accused of allowing customers to exceed daily limits on purchases, and a drug dealer whose 10-year-old daughter was killed in a shootout during a drug deal gone bad at his Denver apartment.
Menninger helped then-Colorado Avalanche goalie Semyon Varlamov prevail in a lawsuit brought against him by a former girlfriend seeking damages for assault and battery.
Menninger convinced a judge to block evidence of graphic pictures and descriptions of beatings Varlamov allegedly had given his former girlfriend. Varlamov is now a goalie for the New York Islanders.
Menninger is a graduate of Duke University and Stanford Law School.
Jeffrey Pagliuca
Jeffrey Pagliuca is an attorney at the same Denver law firm as Menninger and also worked as a public defender in Colorado before joining the firm. Pagliuca’s notable cases include a Colorado Springs real estate developer, Ray Marshall, accused of embezzling $1 million from a city incentive package designed to keep the U.S. Olympic Committee headquarters in Colorado Springs. The charges against Marshall were dropped eight years later.
Pagliuca also represented Craig Lewis, an editor for the Globe tabloid, who was charged with bribery and extortion for allegedly trying to buy a copy of the ransom note for JonBenet Ramsey, the 6-year-old child beauty queen found dead in her Boulder, Colorado, home whose death attracted worldwide attention. Charges against Lewis were dismissed after he agreed to donate $100,000 to a journalism ethics program at the University of Colorado. Pagliuca also represented Maxwell in the lawsuit brought against her by Virginia Giuffre. Pagliuca is a graduate of Duke University and the University of Denver College of Law, where he has also taught.
Christian Everdell
Christian Everdell worked as a federal prosecutor in the Southern District of New York for nearly a decade, spending time as part of of the district’s terrorism and international narcotics unit and its complex frauds and cybercrime unit.
He brought cases against members of Al Qaeda, FARC and other terrorist groups as well as Russian arms dealer Viktor Bout and the founders of a digital currency called Liberty Reserve that was used to launder nearly $8 billion. While at SDNY, he was part of a team that brought charges against Joaquin “El Chapo” Guzman, for which the team was awarded a True Heroes Award from the Federal Drug Agents Foundation, according to Everdell’s company biography. Everdell graduated from Princeton University and Harvard Law School.

2021.11.18 10:42 ALiddleBiddle Biden nominates Ghislaine Maxwell's judge, Memphis litigator to appeals courts
By Nate Raymond
Link to article (Reuters) - President Joe Biden on Wednesday nominated the Manhattan federal judge overseeing the sex abuse trial of British socialite Ghislaine Maxwell and a Memphis litigator at the law firm Butler Snow to serve as federal appellate court judges.
The announcement came a day after U.S. Senate Majority Leader Charles Schumer revealed he had recommended Biden nominate U.S. District Judge Alison Nathan for a seat on the New York-based 2nd U.S. Circuit Court of Appeals.
Biden also nominated Andre Mathis, a partner at Butler Snow experienced in commercial and government litigation and criminal defense work, for a seat on the Cincinnati-based 6th U.S. Circuit Court of Appeals.
Biden has used his 64 judicial nominees to date to further diversify the bench. If confirmed, Nathan would be the second openly LGBT woman to serve on an appeals court and Mathis would be the first Black man confirmed to the 6th Circuit in 24 years.
Nathan addressed her potential nomination on Wednesday morning prior to Biden's announcement while presiding over jury selection in the trial of Maxwell, who prosecutors say recruited and groomed underage girls for deceased financier Jeffrey Epstein to abuse.
"Needless to say, I'm very honored," she said.
But Nathan stressed that she would "continue to do my day job, which means presiding over this trial until completion and handling the hundreds of other civil and criminal matters on my docket."
Maxwell has pleaded not guilty to sex trafficking and other crimes.
Mathis declined to comment

2021.11.17 23:06 ALiddleBiddle Ghislaine Maxwell judge will finish trial despite possible promotion
By Ben Feuerherd
Link to article The Manhattan federal judge presiding over the Ghislaine Maxwell sex-trafficking trial will finish the case — even though she may be promoted to a position on a federal appeals court, she said Wednesday.
“I will continue to do my day job, which includes presiding over this trial until completion,” Judge Alison Nathan said in court Wednesday morning after reports of her possible promotion to the 2nd Circuit Court of Appeals were published.
She added that she was “honored” at the possibility to serve on the appeals court.
In a statement Tuesday, US Senate Majority Leader Chuck Schumer (D-NY) said he would recommend Nathan for the appeals court job, calling her an “outstanding” jurist.
“Ali Nathan is an outstanding judge for the Southern District of New York and her experience, legal brilliance, love of the rule of law and perspective would be invaluable in ensuring the federal judiciary fulfills its obligation to ensure equal justice for all,” Schumer said in a statement.
“Ms. Nathan is already an accomplished and widely respected judge in the Southern District of New York and would bring a passion for the rule of law and justice to her post on the Second Circuit, as well as profound integrity, compassion and expertise,” he added.
If appointed by President Biden, Nathan would be the second openly gay woman to serve as a federal appellate judge, Schumer said.
Nathan has been quizzing potential jurors for the Maxwell trial about their ability to remain impartial in the high-profile case since Tuesday morning.
She’ll continue the jury selection process until prosecutors and defense attorneys agree on a dozen panelists and six alternates.
Maxwell is accused in a six-count indictment of procuring underage girls for multimillionaire financier Jeffrey Epstein to sexually abuse from 1994 to 2004.
She’s pleaded not guilty.

2021.11.17 02:39 ALiddleBiddle New Wrinkle in Ghislaine Maxwell Trial as Judge May Be Promoted
November 16, 2021
Link to article The Manhattan judge presiding in the high-profile trial of Ghislaine Maxwell, the longtime associate of Jeffrey Epstein, will be recommended to the White House on Tuesday evening for a prestigious federal appeals court post by Senator Chuck Schumer of New York, his office said.
The judge, Alison J. Nathan, 49, has spent a decade on the U.S. District Court for the Southern District of New York. On Tuesday, she was overseeing jury selection in the trial of Ms. Maxwell, who has been charged with sex trafficking and with helping Mr. Epstein recruit, groom and ultimately sexually abuse girls. Ms. Maxwell has pleaded not guilty.
The trial, in which opening arguments are scheduled for Nov. 29, could last six weeks, defense lawyers and prosecutors have said in court filings.
If Judge Nathan is nominated by President Biden and confirmed by the Senate during the trial, she could still continue to preside in the case, two legal ethics experts said. Judges are frequently elevated to appeals courts from lower courts where they are actively involved in trials and other cases.
Still, the Maxwell trial, with its connection to Mr. Epstein and the worldwide attention it has attracted, is anything but a routine matter.
Asked whether Judge Nathan would stay on the case if nominated for the appellate judgeship, Edward Friedland, a spokesman for the District Court, said in a statement that he could “neither confirm nor deny that she is under consideration.”
“But I have every reason to believe that if she is recommended or nominated she would — as is customary for lower court judges who are nominated to higher courts — continue to do her day job and preside over the trial to its conclusion,” Mr. Friedland said.
Mr. Schumer, the Democratic majority leader and the party’s senior lawmaker in New York State, is recommending Judge Nathan for a seat on the influential U.S. Court of Appeals for the Second Circuit, which is one level below the Supreme Court.
The recommendation means Judge Nathan is almost certain to be nominated by the White House, as presidents, in choosing judges and U.S. attorneys, traditionally defer to their party’s senior lawmaker in each state.
Mr. Schumer, in a statement on Tuesday, said Judge Nathan’s “experience, legal brilliance, love of the rule of law and perspective would be invaluable in ensuring the federal judiciary fulfills its obligation to ensure equal justice for all.”
Mr. Schumer’s office also noted that Judge Nathan would be the second openly gay woman to serve on the Second Circuit.
Judge Nathan was appointed to the District Court by President Barack Obama in 2011. She earlier served as a special counsel to the solicitor general of New York State, in the state attorney general’s office. Before that, she was an associate White House counsel and special assistant to Mr. Obama.
Judge Nathan is a graduate of Cornell Law School and served as a law clerk to Justice John Paul Stevens in the Supreme Court’s 2001-2 term.
It is not unprecedented for a federal appellate judge, even after confirmation, to continue to hear cases in the trial court, the legal experts said.
At least two former judges on the District Court in Manhattan — Denny Chin and Richard J. Sullivan — continued to handle cases in the lower court after they were appointed to the Second Circuit.
Rebecca Roiphe, a professor at New York Law School, said the only theoretical issue she could foresee would be if Judge Nathan were confirmed quickly and her new duties pulled her away “from a very time-consuming trial.”
“But I think that’s unlikely given the timeline here,” Professor Roiphe said.
Stephen Gillers, a professor at New York University School of Law, said one hypothetical question was whether Ms. Maxwell’s lawyers might seek to have the judge recuse herself because the Biden administration would be in a position to derail her promotion if she did not favor the government in the trial.
But he said in his view, based on hundreds of cases involving judicial recusal, a promotion like Judge Nathan’s would not provide a basis for such a request.
“This does not even come close to the sort of interest that leads to recusal,” he said.
Judge Nathan is known for her independence, and in at least two cases she issued blistering criticism of the U.S. Attorney’s Office in Manhattan after it was accused of failing to turn over potentially favorable evidence to the defense before trial.

They bring a bachelor party culture,” said Khara Jabola-Carolus, executive director of the Hawaii State Commission on the Status of Women...
= = =
Some of the social science assertions coming from Khara Jabola-Carolus’s report:
Gambling With Women’s Safety: – A Feminist Assessment of Proposed Resort-Casino:
Nationally, a person being sex trafficked in a hotel/resort setting is forced, coerced, or intimidated to perform sex acts on an average of 5 to 10 customers per day. (p. 2)
Sex trafficking is distinct from prostitution: sex trafficking is the means, prostitution, pornography and stripping are the ends. Both are relatively new problems in Hawaiʻi that became systematic after Western contact. (p. 2)
According to law enforcement (Spotlight) data compiled by The Avery Center, there (is an estimate of) a total 18,375 sex trafficking victims in Honolulu...(that's a total of)...23,887,812 commercial sex acts per year performed by sex trafficking victims in Honolulu. (p. 3)

Viewpoints on sex trafficking from other sources:
Reason, May 2019
The Sex Trafficking Panic: When police charged New England Patriots owner Robert Kraft with soliciting prostitution, the press said the police rescued sex slaves. "They were women who were from China, who were forced into sex slavery," said Trevor Noah on The Daily Show. We're told this happens all the time.
It's bunk, says Reason Associate Editor Elizabeth Nolan Brown. In the Robert Kraft case, she points out, "They had all these big announcements at first saying they had busted up an international sex trafficking ring, implying these women weren't allowed to leave.” But now prosecutors acknowledge that there was no trafficking. The women were willing sex workers...
Politicians tell us that thousands of children are forced into the sex trade. "Three-hundred thousand American children are at risk!" said Rep. Ann Wagner on the floor of Congress…
...celebrities...perpetuate the myth that sex slavery is rampant. "You can go online and buy a child for sex. It's as easy as ordering a pizza," says Amy Schumer. "Thousands of children are raped every day!" says comedian Seth Meyers...
The Guardian, a decade ago:
Prostitution and trafficking – the anatomy of a moral panic There is something familiar about the tide of misinformation which has swept through the subject of sex trafficking in the UK: it flows through exactly the same channels as the now notorious torrent about Saddam Hussein's weapons. In the story of UK sex trafficking, the conclusions of academics who study the sex trade have been subjected to the same treatment as the restrained reports of intelligence analysts who studied Iraqi weapons – stripped of caution, stretched to their most alarming possible meaning and tossed into the public domain. There, they have been picked up by the media who have stretched them even further in stories which have then been treated as reliable sources by politicians, who in turn provided quotes for more misleading stories...
("...the conclusions of academics who study the sex trade..." More than a few academics will regularly come up with the exact conclusions they want to find.)
The New Republic, Oct. 2015:
"Human Trafficking" Has Become a Meaningless Term – Politicians and activists often abuse it to push for punitive laws or to incite moral panic. President Barack Obama has famously declared that "human trafficking" is "modern-day slavery." He's also said that it "is a crime that can take many forms." The second definition is a good deal more accurate. "Trafficking," in practice, is less a clear-cut crime than a call to moral panic. The vagueness of the definition allows or even encourages governments, organizations, and researchers to claim that there are tens of millions of trafficking victims worldwide on the basis of little more than hyperbolic guesses...
According to Alison Bass, author of Getting Screwed: Sex Workers and the Law, "trafficking has become a new name for an old problem, which is largely teenage runaways." Young people who run away from abusive situations at home, and who sell sex to survive, are considered trafficking victims by default under many federal and state laws. This, despite the fact that hardly any teen runaways have pimps or traffickers, according to a John Jay College of Criminal Justice study. Most see sex work as the best way to support themselves on the street, given the limited legal and social service options available for children who run away from home. And most, Bass told me, do not travel out of their own town or city, much less out of the country...

2020.07.06 20:29 upsidedownsideoffic How I would make a live action Archer movie
Okay so for producer I would pick Seth Rogen, now hear me out he is a producer for the boys, and tone wise it would be similar to archer. He could also play cyril. Now for director it would be James Gunn. He is also a nice fit. Now the writing team should be the same as the animated show. Now for the role of Archer it would have to be Henry Cavill. He is just a spitting image of sterling. Now for the role of Lana, she should be played by Megan Thee Stallion. It is just a role that she would be perfect for. Now for the role of cheryl/carol, it would have to be Alison Brie. I mean her voice is close enough to Cheryl/Carol, and I think she can pull off the crazy type. Now for kreiger, I’m not so sure about who could play him. I think lucky Yates should keep his role. Now my casting for mother is extremely obvious. Who else but Jessica Walter? She is just perfect as the horrible mother type. Now Pam could be played by LITERALLY ANYONE THAT IS NOT AMY SCHUMER OMG PLEASE DON’T CAST AMY SCHUMER IT WILL RUIN THE MOVIE. But seriously, rebel Wilson is perfect as the role of Pam, and British actors play Americans all the time in movies so that is not an issue. The plot of the movie could be like the episode Dial M for Mother. The tone would be light-hearted and filled with dark humour, but can also get serious. And also, imagining henry cavil acting like an 8 year old asking Jessica Walter for a grilled cheese is literally the funniest thing ever xD. So what do you guys think? What would you change?

2019.07.30 02:28 Vegerot List of Joe Rogan Experience Guests by appearances (from /r/joerogan)
Hey, guys. First time posting here. I was watching an episode of the JRE recently and wondered who was the most frequent guest on the show. Joey Diaz? Tom Segura? Eddie Bravo? I tried looking it up and found
this post a few years ago by
jsfly, but couldn't find anything recently. Additionally, I wasn't sure how he came across his information, but it appeared to be a very laborious process.
So, instead of spending an hour tallying each guest from #1325 to #1, I spent
four hours writing
a code that will do it for me. This has the advantage of (once I wrote it) being much faster, and the fact that this can be run at any point in the future, so there can always be an up-to-date list of podcast guests.
Without any further ado, from over 700 guests across almost 1400 podcasts, here are the most frequent guests on the Joe Rogan Experience:

2019.07.30 02:02 Vegerot Most Frequent Guests on JRE
Hey, guys. First time posting here. I was watching an episode of the JRE recently and wondered who was the most frequent guest on the show. Joey Diaz? Tom Segura? Eddie Bravo? I tried looking it up and found
this post a few years ago by

So, instead of spending an hour tallying each guest from #1325 to #1, I spent
four hours writing
a code that will do it for me. This has the advantage of (once I wrote it) being much faster, and the fact that this can be run at any point in the future, so there can always be an up-to-date list of podcast guests.

- So it seems Uncle Joey wins after all, with a total of 49 appearances!
- Brian Redban is interesting, because he is in many episodes that he's not listed in
- Was surprised to see some people had been on more times than I realized
This product isn't perfect, and there's some bugs with it. Please see the source code
here for details on that.
It was fun to work on this, and hope you guys enjoy this data. If you notice any problems, please let me know. If you guys want to make it even better, please feel free to fork me!
Edit: I was thinking while writing this code if Jordan Peterson's conjecture that in any creative work "The square root of the number of people have 50% of the results" applies to JRE guests. So I calculated it and found that, in fact, the top square root percent of guests have almost
40% of all the appearances.
That's really cool! That even though Joe has had hundreds of guests, just a few make up almost half the people on the show. Very interesting
